1. Acceptance of These Terms

By accessing or using this website, you agree to these Terms of Use. If you do not agree, please do not use the Site.

This website, www.rosenjcc.org, is operated by the Jack & Lee Rosen Jewish Community Center, Inc. (the “JCC,” “we,” “us,” or “our”), a nonprofit organization located at 11184 S. Apopka Vineland Road, Orlando, Florida 32836. These Terms apply to all pages, online registration and payment tools, member portals, email newsletters and any other online service we offer that links to these Terms (together, the “Site”).

These Terms work together with our Privacy Policy and any program-specific agreements, waivers or membership agreements you sign. If a program agreement conflicts with these Terms, the program agreement controls for that program.

2. Eligibility, Minors and Accounts

You must be at least 18 years old to create an account, buy a membership, register for programs or make a payment on the Site. Parents or legal guardians must complete all registrations for children, including camp, early childhood, youth sports and after-school programs.

The Site is not directed to children under 13. We do not knowingly collect personal information directly from children under 13; information about children is collected only from their parent or guardian as part of registration. If you believe a child has given us personal information, contact us and we will delete it.

If you create an account, you agree to:

• Provide accurate, current information and keep it up to date.
• Keep your password confidential and not share your account.
• Notify us promptly at info@rosenjcc.org if you suspect unauthorized use.
• Accept responsibility for activity under your account.

We may suspend or close an account that violates these Terms or our membership policies.

3. Memberships, Registrations, Payments and Donations

Online purchases are subject to availability and to the policies of the specific membership, program or event. Program descriptions, schedules, fees and age requirements may change, and we may cancel or modify a program due to low enrollment, weather, safety concerns or other circumstances.

Payments. You agree to pay all fees and charges at the prices in effect when you register. You authorize us and our payment processor to charge your selected payment method, including recurring charges for monthly memberships or payment plans until you cancel as described in your membership agreement. Payment card data is handled by our third-party payment processor and is not stored on our servers.

Refunds and cancellations. Refunds, credits, transfers and membership freezes follow the policies posted for each membership or program. Unless a policy says otherwise, registration fees and deposits are non-refundable.

Waivers. Some programs and facility use require a signed release, waiver, health form or code of conduct. Registration is not complete until required forms are submitted.

Donations. Donations made through the Site are voluntary and generally non-refundable, except for processing errors reported within 30 days. The JCC is a 501(c)(3) nonprofit organization; contributions are tax-deductible to the extent allowed by law, and we will provide a receipt. If you receive goods or services in exchange, the deductible amount may be reduced. Consult your tax advisor about your situation.

Florida charitable solicitation disclosure. A COPY OF THE OFFICIAL REGISTRATION AND FINANCIAL INFORMATION MAY BE OBTAINED FROM THE DIVISION OF CONSUMER SERVICES BY CALLING TOLL-FREE (800-435-7352) WITHIN THE STATE. REGISTRATION DOES NOT IMPLY ENDORSEMENT, APPROVAL, OR RECOMMENDATION BY THE STATE. Registration No. CH 46992.

4. Acceptable Use and User Content

The JCC welcomes people of all backgrounds, and we expect the Site to reflect the same respect we expect in our building. You agree not to use the Site to:

• Post or send content that is unlawful, harassing, threatening, defamatory, obscene, or hateful, including antisemitic or other content that targets people based on religion, race, ethnicity, national origin, gender, sexual orientation, disability or age.
• Impersonate any person or misrepresent your affiliation with the JCC.
• Register or pay for programs using another person’s identity or payment method without permission.
• Post photos, names or personal details of children other than your own.
• Send spam, solicitations or unauthorized advertising, or harvest other users’ contact information.
• Upload viruses or malicious code, probe or breach security, or interfere with the Site’s operation.
• Scrape, copy or collect Site content by automated means without our written permission.
• Violate any law or anyone else’s rights.

Your content. If you submit content such as reviews, comments, photos, event submissions or testimonials, you confirm you have the right to share it. You grant the JCC a non-exclusive, royalty-free, worldwide license to use, display, edit and share it in connection with our mission and operations. You keep ownership of your content.

We may review, edit or remove any content, and restrict access for anyone who violates these Terms, at our discretion. We are not obligated to monitor content and are not responsible for content posted by others.

5. Intellectual Property, Links and Privacy

Our content. The Site’s text, graphics, logos, photos, videos, program materials and design are owned by the JCC or its licensors and protected by copyright and trademark law. “Jack & Lee Rosen Jewish Community Center,” “Rosen JCC” and all the organization’s related logos are our marks. You may view and print pages for personal, non-commercial use, such as sharing a schedule with family. Any other use requires our written permission.

Copyright complaints. If you believe content on the Site infringes your copyright, please send a written notice to our designated copyright agent:

Your notice must include the information required by the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)), including: your physical or electronic signature; identification of the copyrighted work; identification of the allegedly infringing material and where it appears on the Site; your contact information; a statement that you have a good-faith belief the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Photos and media. Photos and videos taken at JCC programs and events may appear on the Site and our social media, as described in our program registration forms and media policy. To request removal of an image of you or your child, contact info@rosenjcc.org.

Third-party links and services. The Site may link to or use third-party services, such as payment processors, registration platforms, social media, maps and partner organizations. We do not control and are not responsible for their content, policies or practices. Your use of them is governed by their terms.

Privacy. Our Privacy Policy explains how we collect, use and protect personal information, including information about children submitted by parents. By using the Site, you acknowledge that policy.

6. Disclaimers, Limitation of Liability and Indemnification

No warranties. The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, the JCC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free or free of viruses, or that schedules, prices and other information are always current.

Health and fitness information. Fitness, wellness, nutrition and aquatics content on the Site is for general information only and is not medical advice. Consult a physician before starting any exercise program. Participation in JCC activities is governed by the waivers and policies for those activities.

Limitation of liability. To the fullest extent permitted by law, the JCC and its directors, officers, employees, volunteers and agents will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed the greater of the amount you paid us through the Site in the 12 months before the claim or $100. This section does not limit liability that cannot be limited under Florida law.

Indemnification. You agree to defend, indemnify and hold harmless the JCC and its directors, officers, employees, volunteers and agents from claims, losses and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, your content or your misuse of the Site.

7. Governing Law, Changes and General Terms

Governing law and venue. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute relating to the Site will be brought exclusively in the state or federal courts located in Orange County, Florida, and you consent to their jurisdiction.

Changes to these Terms. We may update these Terms from time to time. The “Effective date” above shows when they last changed. Material changes will be posted on the Site and may be emailed to account holders. Continued use of the Site after changes take effect means you accept them.

Changes to the Site. We may change, suspend or discontinue any part of the Site at any time without notice.

Accessibility. We aim to make the Site usable for everyone. If you have trouble accessing any content or registration, contact info@rosenjcc.org or call (407) 387-5330 and we will help.

General. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, with our Privacy Policy and any program agreements, are the entire agreement between you and the JCC about the Site. You may not assign your rights under these Terms; we may assign ours.
